Terms of Service

AiAkaun is a product of Data Brain Sdn. Bhd. (1335252-P), Tingkat 1, 2309, Jalan SJ 10/1, Taman Seremban Jaya, 70450 Seremban, Negeri Sembilan, Malaysia.
These Terms of Service ("Terms") govern your use of the AiAkaun website and accounting system (the "Service"). By registering, subscribing to, or using the Service, you agree to be bound by these Terms.
PDPA roles: You act as the Data Controller for your company data, while AiAkaun acts as the Data Processor under the Personal Data Protection Act 2010 (Amendment 2024). A separate Data Processing Agreement (DPA) is available. View DPA →
1. Services
AiAkaun is an AI-powered accounting system: you upload bank statements/receipts and AI reads and classifies transactions per MPERS principles, then generates financial statements, tax estimates, SST and payroll. One account may hold several companies, each with its own set of books. The Service is provided "as-is" without guarantee of absolute accuracy; you must review all outputs before any official use.
2. Account & access
You must be at least 18 years old or an authorised company officer. You are responsible for keeping your password and API keys confidential, and must report any unauthorised access immediately.
3. Subscription & payment
Subscriptions are charged PER COMPANY, on the plan you choose — RM39 per month or RM390 per year for one company. If you keep several companies, each carries its own subscription. Payments are processed via Billplz (FPX or card). Invoices and receipts are generated automatically. Refunds are limited to failed or incorrectly charged transactions only.
4. Trial, grace period & cancellation
Your first company is eligible for a 14-day free trial. After a subscription lapses there is a short grace period before that company's books switch to read-only: you can still sign in, view and export records, but not add new entries. We do not delete your data over an unpaid balance. You may cancel yourself at any time from My Account, and access runs to the end of the period already paid for.
5. Prohibited use
You may not: upload unauthorised documents; attempt unauthorised access (e.g. path traversal, SQL injection); reverse engineer; excessively scrape; or violate Malaysian law. Violations may result in immediate account suspension.
6. Intellectual property
AiAkaun, its logo, source code and algorithms remain the exclusive property of Data Brain Sdn. Bhd.. Data you upload remains yours; you grant us a limited licence to process it solely for the purpose of delivering the Service.
7. Limitation of liability
Our maximum liability in any 12-month period is limited to the fees you paid during that period. We are not liable for lost profits, reputational harm, indirect damages, or force majeure. These exclusions do not apply to gross negligence, wilful misconduct, or statutory obligations that cannot be excluded.
8. Indemnity
You agree to defend and indemnify Data Brain Sdn. Bhd. against any third-party claims arising from unauthorised data uploads, unlawful use of the Service, or breach of these Terms.
9. Termination
You may terminate your account at any time from My Account. We may terminate or suspend accounts for violations with 7 days' notice (or immediately for serious breaches). Data will be anonymised within 30 days of termination, subject to statutory retention periods.
10. Accounting & compliance responsibility
AiAkaun generates draft financial statements, tax estimates and suggestions. You remain solely responsible for verifying accuracy, obtaining director approval and auditor signatures, and meeting SSM/LHDN/Customs deadlines. AiAkaun is not an official filing agent or tax agent.
11. Governing law & jurisdiction
These Terms are governed by the laws of Malaysia. Any disputes shall be heard in the Malaysian courts, with preferred jurisdiction in Seremban, Negeri Sembilan.
12. Changes to terms
We may update these Terms with 14 days' notice by email. Continued use thereafter indicates your acceptance.
